1. Agreement to Terms

By accessing or using Bakery.net ("Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Bakery.net is a marketplace platform that allows independent bakers to list, promote, and sell their own products directly to customers.

The Service provides:

• Profile pages for home bakers to showcase their products
• Search and discovery features for customers to find local bakers
• Order inquiry and payment processing capabilities (via Stripe)
• Communication tools between bakers and customers

3. User Accounts

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

4. Baker Responsibilities

If you operate as a baker on the platform, you agree to:

• Comply with all applicable cottage food laws, health regulations, and local ordinances
• Accurately represent your products, prices, and availability
• Fulfill orders in a timely and professional manner
• Handle customer service, refunds, and disputes directly with customers
• Maintain appropriate food handling licenses and insurance as required by law
• Respond to customer inquiries within 48 hours

5. Payment Processing & Fees

Payment processing is handled by Stripe, Inc. When bakers accept online payments through the platform:

• Stripe Processing Fee: 2.9% + $0.30 per transaction (paid to Stripe)
• Platform Fee: 3.9% of the order total (paid to Bakery.net)
• Total Fees: Approximately 6.8% + $0.30 per transaction
• Bakers receive payouts within 2 business days via Stripe
• Platform fees are automatically deducted from transactions and are non-refundable

Bakers who choose not to accept online payments may use the free inquiry system with no platform fees.

6. Refunds and Disputes

Bakery.net is a marketplace platform, not the seller of goods. Therefore:

• Refund policies are determined by individual bakers
• Disputes must be resolved directly between baker and customer
• Chargebacks and payment disputes are handled through Stripe
• Platform fees are not refunded in the event of order cancellation or refund
• We reserve the right to deactivate accounts involved in fraudulent activity or excessive disputes

7. Prohibited Activities

You may not:

• Sell products that violate local cottage food laws
• Post false, misleading, or fraudulent listings
• Harass, abuse, or harm other users
• Use the Service for any illegal purposes
• Scrape, copy, or steal content from the platform
• Impersonate other users or bakers

Note: Bakers may use our free inquiry system and arrange payment directly with customers. Only credit card transactions through the platform are subject to platform fees.

8. Intellectual Property

Bakers retain ownership of their content (photos, descriptions, recipes). By using the Service, you grant Bakery.net a license to display your content on the platform and in marketing materials. The Bakery.net platform, design, and branding are owned by Bakery.net.

9. Account Termination

We reserve the right to suspend or terminate accounts at our discretion for violations of these terms, fraudulent activity, excessive customer complaints, or illegal activity. You may close your account at any time from your dashboard settings.

10. Liability Disclaimer

Bakery.net is a platform connecting buyers and sellers. We are not responsible for:

• Quality, safety, or legality of products sold
• Accuracy of baker listings or product descriptions
• Conduct of bakers or customers
• Food allergies, illness, or injury from consumed products
• Failed deliveries or unfulfilled orders

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

11. Limitation of Liability

To the maximum extent permitted by law, Bakery.net shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total liability for all claims shall not exceed the lesser of (a) $500 or (b) the total platform fees paid by you in the 12 months preceding the claim.

12. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting. Continued use of the Service constitutes acceptance of modified terms.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Nevada, United States, without regard to conflict of law provisions. Any legal action or proceeding arising under these terms shall be brought exclusively in the courts of Nevada.
